Mulligan was born in Lexington, Kentucky, son of the locally prominent businessman Dennis Mulligan and Ellen Alice (McCoy) Mulligan. He graduated from St. Mary's College in 1864 and received his law degree from Kentucky University (now Transylvania University) in 1869.

Judge Mulligan was an editor, attorney, judge, legislator (Kentucky House 1881-1889 and Senate 1889-1893), consul-general to Samoa (1894–1896), and orator. While in Samoa, he befriended English novelist Robert Louis Stevenson. Mulligan was himself an editor and poet. His poem "In Kentucky" is perhaps the best known poem about the state, which he delivered at the close of a speech at the Phoenix Hotel in Lexington in 1902.

He married Mary Huston Jackson in 1869 and they had four children. Mary Mulligan died in 1876. Judge Mulligan married Genevieve Morgan Williams in 1881 and they had six children.

His home, Maxwell Place, is now the official residence of the president of the University of Kentucky. He is buried in Calvary Cemetery in Lexington.

In the Fall of 1904 a plot to poison the family of James Hilary Mulligan was uncovered.
They had set down to a salmon dinner in Sept 1904 when the house boy summoned Dennis Mulligan to the side and asked him not to eat the salmon. When Dennis questioned Louis Mitchell further, he told him that it has arsenic in it and asked him to tell the other family members not to eat it.

In Dec 1904 the trial of Louis Mitchell began.
In a sworn statement by Louis Mitchell it said that James Jackson Mulligan was going to pay him to poison Mrs. Mulligan, meaning Jennie. When Mitchell told James Jackson Mulligan that it would kill the rest of the family as well, his reply was no matter. He was going to pay Louis $100 after the funeral. James was exonerated in Oct 1904 of all charges.

In Jun 1905 Louis Mitchell was acquitted.
Louis Mitchell was dismissed in the Circuit Court Wednesday morning on a charge of attempting to poison Mrs. James H. Mulligan. Mitchell was the long trusted servant of Judge Mulligan's family and a motive for the crime was wanting. The jury returned a verdict of not guilty within several minutes and Mitchell was discharged."
