Squire John Fishback

"lived on Negro Run and died in Culpeper Co early in 1828. ... he may have been born as late as 1747, for the land tax-lists of Culpeper Co. frequently refer to him as John Fishback, Jr. to distinguish him from his somewhat older cousin, John Fishback, son of Jacob, who was born in 1743 and is called John Fishback Sr. John Jr. was a justice of Culpeper Co during the years 1811-1815, and was called "Squire John" having been a Justice of the Peace for 40 years; p.166; The following records distinguish this John Fishback from John Fishback, Sr. son of Jacob: 1798-1803 land-taxes on 648 acres, 1811-1815 Gent, one of the gentlemen justices of county, with 698 acres, 1816-1823 of Negro Run with 348 acres, 1824-1826 with 306 acres, 1827-29 as John Fishback, Jr. Culpeper Index of Will shows John Fishback, will on page 58 of the lost will Book "L" 1827-30, 57 pages after the will of John Fishback, Sr. (son of Jacob). Order Book 15, p4 17Mar1828, the will of John Fishback is ordered to be recorded, and Daniel Ward, one of executors. Ward was son-in-law of Martin Fishback, John's brother."

"( 1 ) The land-taxes 1798-1803 show him as "John Fishback'* with 648 acres: from 1811-1815 as "John Fishback (G)" (i.e., "Gent.", one of the gentlemen justices of the county) with 698 acres : from 1816-1823 as "John Fishback N. Run- (i.e.. of Negro Run) with 348 acres: from 1824-1826 with the same title but only 306 acres: and 1827-29 its "John Fishback, Jr." 306 acres (though he was dead in 1829, the land was still carried in his name,). After 1829, he disappears from the land-taxes, as his son John. living in Kentucky. sold his land in that year.

(2) The Culpeper Index of Wills shows "John Fishback, will" oil p. 58 of the lost will Book -L". 1827-30, 57 pages after the will of John Fishback, Sr. (son of Jacob). This indicates, that "Squire John" died in 1828, which Is confirmed by the following records :

(3) Order Book 15, p. 4. Mar. 17, 1828 the will of John Fishback is ordered to be recorded, and Daniel Ward, one of the executors. qualified. Daniel Ward was a son-in-law of Martin Fishback, John's brother.

(4) Same, p. 309. Feb. 15, 1830, Daniel Ward, executor of ' John Fishback, decd.. is to have his accounts of the estate examined and settled.

(5) D. B. "VV", p. 357. May 21, 1829, John Fishback and El 1 zabeth his wife of Allen Co., Kv sell 290 acres to Edward Settle of Culpeper Co. This was no doubt the last of "Squire John's" land.

The following from the Culpeper Co. tithables shows something of John Fishback, son of Frederick, John Fishback son of Jacob, John Fishback, Jr. (son of Jacob's John) and James and William Fishback, sons of either Frederick's John or Jacob's John. It is not always easy to distinguish the two older John's in the tithables, but something can be gathered regarding the ages of their sons from them:

1782-89: John Fishback and ohn Fishback, son of Jacob, only I tithable each.
1793: John 3, John son of Jacob 1. (Squire John then had 2 sons
b. before 1777).
1794: John 3, John 1.
1795 John 3, John, Sr. 3 (showing that John son of Jacob had
2 sons b. before 1779).
1796: John 3, John son of Jacob 1.
1798: John 4 (indicating three sons b, before 1782), John son of
Jacob 1.
1799: John 2. James I (this was probably James, son of "Squire
John"), John 2.
1800: John 3, John 3 (both men had 2 sons over 16 in their
families).
1801 James 1, John L. John 3 (this is the last year in which this
James appears and he probably moved away).
1802: John 3, John 2; William I in another section of Culpeper.
1803: John 1, John Sr. 5, John 1 (the third John seems to have
been John, eldest son of Jacob's John, and it would appear
that John, Sr. or Jacob's John had 4 sons over 16 in his
family this year, though besides John, Jr., William and
James, we do not know the names of these other 2 sons)
William 1 in another section.
1804: John 2, John son to John I (i.e., John son of Jacob's John)
William 1 in another section. This is the last year in which
William appears and he probably moved away. He may
be identical with a William Fishback who married Pamelia
A. Johnson, daughter of Benjamin and Frances Johnson
in Henry Co., Va. Feb. 2, 1810 (Dodd "Henry County Mar-
riage Bonds"). However, this is uncertain, as it is also un-
certain whether the William Fishback of the tithables
1802-4 was son of "Squire John" or of Jacob's John.

There is a gap in the tithables 1805-10, but 1811 shows "John (G) (i.e., "Gent," or "Squire John") 2 tithables, John son of Jacob 1, and John Jr. 1. The same is shown after these years, except that '*John (G)" is shown with only 1 tithable afer 1812, and that "John" (i.e., Jacob's John) is shown as levy free in 1814, though still with I tithable, probably his son James or his son William. In 1830, except for "Squire John's'' brother, Martin Fishback, and his family, only John, Jr, and James C. Fishback (sons of Jacob's John) are shown.

In addition to the two older John Fishbacks (the son of Jacob and the son of Frederick) and their two sons, John. there was a fifth John Fishback in Culpeper Co. whom it is hard to place. This John Fishback never appears in the tithables, but died in Culpeper Co. in 1804. At the February Court, 1804 George Duncan was appointed administrator of John Fishback, decd., with William Duncan as his security (Culpeper Minute Book 3. p. 141), and the inventory of John Fishback, decd., was recorded Mar. 21, 1804 (Will Book "E". p. 54)."
